Illegal Police Raid on Anti-RNC Convergence Space in St. Paul

[TC-IMC Update 2 AM - Web media takes notice: TC Daily Planet: Police break down doors in night-time raid on anarchist meeting, Minnesota Independent: Rumors circulating of possible police sweeps in Minneapolis this weekend]

At 9:15 Friday night, the Saint Paul Police entered all doors of the RNC Convergence Space in St. Paul, MN with guns drawn. The Space serves as a community center and organizing space for the upcoming protests against the Republican National Convention. At the time of the raid, people were sitting down to dinner and watching a movie.

The police presented no warrant at the time of the raid, but claim that they have a warrant to search the space for "bomb-making" materials. No "bomb-making" materials were found. Rather, the police barked orders for everyone, including a 5 year old child, to get on the floor with their faces to the ground. Everyone inside was put in handcuffs.

In the hours following, the police photographed everyone inside the space and recorded information from their Identification cards. The police took all personal laptops and hard drives.

One female activist was sexually harassed by a cop who groped her crotch.

At around 11pm, after a crowd had gathered outside the space, the police began releasing detainees one by one. Corporate media showed up eventually. By midnight, the last detainees were being released.

As of the most recent reports, there have been NO ARRESTS.

The police are claiming that the space must be closed down due to "fire code" violations. According to City Council member Dave Thune, the police do not have the authority to enforce fire code. Only the Fire Department has the power to enforce this code.

FRIDAY AUGUST 29 2008

Assitant Police Chief Bostrom has talked about the St. Paul Standard, and on the anniversary of last years’ critical mass police riot, we saw its true face. The ramsey county sheriff’s dept and the SPPD raided the RNC convergence space and detained over 50 people in an attempt to preempt planned protests of the rnc on Monday.

Looking for items found in any twin cities house like jars, paint, and rags, this attempt to portray us as criminals and destroy our credibility has already backfired as evidenced by the masses who have come to support us.

We are now accused of a simple fire code violation -which is outside the scope of the sheriffs department and clearly not justified provocation for a forceful raid with guns being drawn. Children and elderly people were inside the convergence center when the police violently busted down the doors. The police may claim that the raid was executed according to protocol - however, the violence inherent in this action may only be a hint of the violence to be expected on Monday and beyond, and is only a hint at the violence perpetrated daily by the police.

The convergence center is simply a gathering place and is not used for illegal actions - it is a place for workshops and trainings. Tonight we were watching films and sharing food.

This action will not deter us from our plans to protest the RNC on September 1st. We want to invite all people who oppose this police oppression to join us on Septemeber 1st. See you in the streets.

Legal status? Photos?

Have the detainees been informed of their legal status or allowed access to legal counsel? It sounds like it's been a few hours now, so by this point they should be informed of their legal status (detained, arrested, etc) and either released or at least allowed access to legal counsel.

Also, do you have any photos of the situation yet? I've only been to your site once or twice a long time ago, so I may just be missing them if they do exist. Or maybe due to the chaos, confiscated laptops, security concerns, etc there are no photos. Either way, good luck to everyone. I will spread the word about this (and subsequent RNC happenings) in my local community.

The real objective in this latest afront to the Constitution was to collect photographs and biometric data on innocent people who have the audacity to hold a different woldview than your mainstream Rep or Dem. In similar news, the local police and sheriff's office in my state/county are setting up checkpoints this holiday weekend under the guise of combating drunk driving. They will pull people over for no reason, detain them and search their vehicles without a warrant. Don't you love living in a world where our government (local/state and federal) treat its entire citizenry as if they are all potential criminals/terrorists? I mean really, who are the REAL terrorists here, eh? Personally, I'd rather live under the threat of terrorism and be free than live in fear of my government under tyranny. "Citizen! Your papers, please!"

That's exactly what this is. They know all these protesters are going to be in one place at one time, so they get all their names jotted down. When the convention comes around, expect all these people to conviently be picked up and arrested for various reasons... or there will simply be a list of people to be arrested if they're seen around the convention. There will be no charges, they'll just hold them for the 24-hours they're allowed before booking them, possibly try and hit them with something like "disorderly conduct" and release them... after the convention.

This is how the police tip-toe around the law to making things like this run smoothly, and that's all they care about. Both conventions are all about image, not substance.

Oh, check the news, many protesters were arrested by the Denver police during the DNC convention. However it seems most protesters at the DNC convention broke and run whenever they saw the police in Denver.

Today's protesters don't have the balls that protesters in the 60s had. Basically today's protesters don't really believe in what they are protesting about. They are there just to act as hoolligans and common criminals.

I definitely agree with you - since all elected and unelected officials are always correct, no one should ever protest, because protests are a waste of time and have never accomplished anything. From the Boston Tea Party to women's sufferage to the end of slavery - all the real positive accomplishments in this country have been achieved by people who keep their heads down, do their jobs, and grumble.

When I moved to this country 20 years ago, I swore an allegiance to its flag, its laws and first and most importantly to it's constitution. But mostly in the last 10 years, law enforcement all all levels, have violated the constitution repeatedly. When Al gore was elected as President of the US. I thought the US is more free than it is fascist. But when they took away our votes and used the electoral college political mechanism (scam) to nullify our vote and put someone else as President who was not elected by the majority, I realized that fascism would always prevail in this country and that all men would never be equal under a predominately fascist system. So I have prepared my exodus and I will be leaving it soon. Oh and by the way, its so bad now that some poor woman has an arrest warrant out on her, because her lawn has tall grass!

Actually, I've never been able to understand what the "Protesting" does. How does that change anything at all? Standing there with a sign that says we don't like this or we dont agree does not change anything. Protesting is for pussies that dont know what real action is. Lobbying a changed law or gathering for a new organization that serves the community or forming a car wash or bake sale to repair a building that is in decline; this is action that brings change as an example. Violence should be the absolute last resort for reform in a (quasi-)democratic state, and only used when the ruling power no longer takes any heed of the general public's wishes. We were eventually informed that we were being detained. We were denied access to legal counsel while we were handcuffed in the Convergence Center. We have all been released, one was arrested but he was also released.

Much thanks to everyone who cheered when I was released, and hugged me and everything. You can't possibly imagine how much that meant after the whole ordeal. You are all wonderful people, and hope to see you all on Monday.

Legal Counsel

It would seem those in attendance at the scene of the search warrants need more legal training. "Access to legal counsel" would not be available until after a person has been booked into the Ramsey County jail. The simple fact of a person being detained during a search warrant does not automatically put a person in the position of being afforded legal counsel. As I said in the beginning, even a person being arrested is not automatically afforded counsel until after they are booked into jail. To imply that law enforcement was lacking in not providing counsel immediately is false, misleading and in line with the disinformation being vomited by those who choose to create havoc and disorder rather than constructively work towards the change they claim they want.

Lets talk legalities

Police bash down the door? Is that what is known in the legal profession as a 'No-knock' raid? On what possible grounds would probable cause for the issuance of a no-knock warrant be justified ? A 'rumor' someone was making a bomb? Not sufficient.

What about presentment of the search warrant?

What about the difference between being detained in a house where a search warrant is being executed and everyone being handcuffed?? There is no need for the handcuffs. There was no need for the no knock warrant.

There is no need for people who are aware that our society is leaning fascistic to suffer fools like you who quibble over some minor technicality that someone got wrong (you are not entitled to counsel at that stage but you are entitled to your miranda warnings - were those given?) - and entirely miss the forest for the trees. This is rank intimidation and police state fear mongering. I would also say a prior restraint on protected 1st amendment protest activity. Not to mention potentially tortious and/or criminal assault, battery, and intentional infliction of emotional distress.

Check into Switzerland. I am starting to look into options. Of course, they have a welfare state, which is unavoidable wherever you go. However, they also REQUIRE every able bodied male between 20 and 30 to get military training and serve in the militia (they have no regular army). Regardless of what they believe, the laws still apply to the police. If laws are situational, based up on the beliefs of the people involved, then logically, anarchists can do as they please and could kill said police officers and say, "Hey, we don't believe in laws and neither do you."
