CUAPB, NATIONAL LAWYERS GUILD AND OTHERS FILE EMERGENCY MOTION FOR TEMPORARY RESTRAINING ORDER

In the aftermath of a series of raids on the homes of activists and journalists, the National Lawyers Guild and Communities United Against Police Brutality (CUAPB) filed an emergency motion late yesterday asking weekend signing judge Mark Wernick to grant injunctive relief to prevent police from seizing video equipment and cellular phones used to document their conduct.

Examples of police interference with the right to document their conduct include the beating of CUAPB vice president Darryl Robinson while copwatching, seizure of equipment of three journalists with Glass Bead Collective, and the targeting of journalists during a raid on 951 Iglehart in St. Paul yesterday afternoon.

Another example is the action of Ramsey County Sheriff’s Deputies, who deliberately shut off CUAPB president Michelle Gross’ video camera while she was documenting Friday night’s raid from inside the convergence space. This action prevented her from documenting the incident in its entirety. Despite their actions, Ms. Gross was able to capture about 7 ½ minutes of video and audio of the beginning of the raid, including use by deputies of a battering ram to force open the door to a upstairs theater where families were watching a film. Copies of this footage will be provided to media representatives in attendance at the press conference.

isn't that the judge though that gave the warrants?

Temporary restraining order.

If the judge does the right thing, Gross and Kushner will be laughed out of court.

if the judge does the right thing,

if he's the one who signed off on the warrants, he'll recuse himself and pass the matter on to another judge. Gross and Kushner have a good case on lots of things, not just the obvious 42 US 1983 cases, but on numerous tort causes of action as well. It'll be interesting to see the litigation that comes out of this series of events. It'll also be interesting to see what the local District Attorney does with the charges - if nothing else, if people choose to fight it out in court, the DA will have to expend considerable time and money in what will most probably be a losing cause.

On top of which is the fact that this is a disaster for the Republican Party - which is probably why they'll avoid Minneapolis/St Paul like the plague. It really doesn't look good for the local sheriff to recreate the Palmer Raids - it's a guaranteed loser for any candidate associated with it.

The whole plan is to discourage people from protesting, period. That is why they used the gestapo tactics. They do not want a return of 60's style protests. They want compliant sheep who bleat at home or in their cells.

Against Police Brutality!

Police brutality is sometimes a big problem. Newspaper are full of violent police attacks. These guys and women think sometimes they are above the law. So it is a pleasure to see that there is a blog which shows their mistakes! Well done and please keep on posting.
